Compromise Agreements
Compromise agreements are used to bring certainty to the end of an employment relationship. Under a compromise agreement, an employee agrees to waive their right to bring claims in respect of their employment rights in exchange for a departure package from their employer.
In order for a compromise agreement to be binding, employees must get independent legal advice from a qualified lawyer before signing it. The lawyer will advise them on the claims they may be able to bring and on their rights and obligations under the compromise agreement. It is usual for the employer to make a contribution to the employee's legal costs in respect of this independent legal advice.
